Please read these Terms carefully. By accessing the Services, submitting a form, or otherwise interacting with us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using the Services you represent that you are the property owner (or are authorized to act on behalf of the owner) for any property you ask us to evaluate.
2. About Our Services
HomeMerrit provides direct home-purchase services. When you submit your property information, we may prepare a non-binding estimated offer range and follow up with you to discuss potential cash and/or structured (terms) purchase options. We are not a real estate broker, agent, lender, or financial advisor.
3. No Binding Offer Until Executed
HomeMerrit reserves the right to revise, withdraw, or decline to extend any indicated offer at any time and for any reason prior to a fully executed written agreement.
4. Your Submissions
You agree that any information you submit through the Services is accurate to the best of your knowledge, that you have the right to provide it, and that providing it will not violate any third-party rights or applicable law. You grant us a limited, non-exclusive, royalty-free license to use the information for the purpose of evaluating, communicating about, and (if applicable) closing on your property.
5. Consent to Be Contacted
By submitting your contact information through the Services, you expressly consent to be contacted by HomeMerrit and its agents by phone (including by automatic telephone dialing system or prerecorded/artificial voice), email, and SMS text message at the contact information you provided, even if your number is on a Do Not Call list. Consent is not a condition of any purchase. Message and data rates may apply. Reply STOP to opt out of text messages or use the unsubscribe link in any marketing email.

6. SMS Messaging Program
This campaign sends SMS notifications, alerts, and communications to customers who have opted in to receive SMS notifications from HomeMerrit.
You can cancel the SMS service at any time. Simply text STOP to the shortcode. Upon sending “STOP,” we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

7. Property Information & Accuracy
Offer estimates are based on the information you provide and on data we obtain from public records and licensed third-party sources. Estimates assume the information is accurate, the property is in the represented condition, and there are no undisclosed material facts (e.g., title defects, liens, structural issues). HomeMerrit may revise any estimate after inspection, title review, or further diligence.
8. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share information.
9. Intellectual Property
The Services, including all text, graphics, logos, images, software, and design elements, are owned by HomeMerrit or its licensors and are protected by U.S. and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works of the Services without our prior written consent, except that you may view and print pages for your personal, non-commercial use.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEMERRIT DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Any estimates or offer ranges are informational and do not constitute financial, legal, tax, or real estate advice.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEMERRIT AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our aggregate liability for any claim arising out of these Terms or the Services will not exceed one hundred U.S. dollars ($100). Some jurisdictions don’t allow these limitations; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless HomeMerrit and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) your use of the Services, (b) your breach of these Terms, or (c) your violation of any law or the rights of any third party.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. You and HomeMerrit agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to personal jurisdiction there.
Nothing in these Terms prevents either party from seeking equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date at the top. Material changes will be communicated as required by law or posted prominently. Your continued use of the Services after changes take effect means you accept the revised Terms.
